These Terms & Conditions govern your use of the Mini Atlas Co. website and any retail purchases made through our online store.

Mini Atlas Co. operates under ABN 74 941 628 716.

By accessing our website or placing an order, you agree to these Terms & Conditions together with our Privacy Policy, Shipping & Delivery Policy and Returns, Refunds & Consumer Guarantees Policy.

These Terms apply to retail purchases. Approved wholesale orders may be subject to separate wholesale terms.

1. Products

We take reasonable care to ensure that product descriptions, photographs, dimensions, materials and other information on our website are accurate.

Colours and appearance may vary slightly depending on screen settings, lighting and the nature of the materials used. Some Mini Atlas Co. pieces include hand-finished or individually finished details, and minor variations in stitching, dimensions, print placement or finish may occur.

Such variations are not necessarily product faults, provided the product otherwise complies with its description and applicable consumer guarantees.

We may update product information or discontinue products from time to time. Any change will not affect an order already accepted by us.

2. Orders

Placing an order constitutes an offer to purchase from Mini Atlas Co. An automated order confirmation acknowledges that we have received your order but does not necessarily constitute acceptance of that order.

An order is accepted when we confirm dispatch or otherwise expressly confirm acceptance.

Before an order is accepted, we may decline or cancel it where reasonably necessary, including where an item is unavailable, there is an obvious pricing or listing error, payment cannot be authorised, we reasonably suspect fraud or unauthorised activity, delivery cannot reasonably be completed to the address supplied, or accepting the order would breach applicable law.

If payment has already been taken for an order that we do not accept, the amount paid will be refunded.

Once an order has been accepted, cancellation or amendment requests will be handled in accordance with our Returns, Refunds & Consumer Guarantees Policy and applicable law.

3. Prices, Payment & Promotions

All prices displayed on our Australian store are in Australian dollars and include applicable taxes where required by law, unless otherwise stated.

The total price payable, including applicable delivery charges and other charges disclosed at checkout, will be shown before payment is completed.

Promotional offers, discount codes and other promotions may be subject to additional conditions. Unless expressly stated otherwise, promotional codes cannot be combined.

We reserve the right to correct an obvious pricing, description or technical error before accepting an order.

4. Shipping & Delivery

Customers are responsible for providing accurate and complete delivery information when placing an order.

Delivery dates and transit times are estimates unless we expressly state otherwise. Delays may occur due to postal or courier networks, weather, transport disruption or other circumstances beyond our reasonable control.

Where a delivery problem results solely from incorrect or incomplete information supplied by the customer, reasonable additional delivery costs may be charged where permitted by law.

Nothing in this section limits any rights or remedies available under the Australian Consumer Law.

5. Returns & Consumer Guarantees

Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

Mini Atlas Co. does not offer returns, exchanges or refunds solely for change of mind.

Faulty, damaged, incorrectly supplied or otherwise non-compliant products will be handled in accordance with our Returns, Refunds & Consumer Guarantees Policy and applicable law.

Normal wear and tear, accidental damage, misuse or damage resulting from failure to follow applicable care instructions are not, by themselves, product faults.

6. Intellectual Property

Unless otherwise stated, all content appearing on this website, including Mini Atlas Co. artwork, illustrations, maps, patterns, designs, photographs, product imagery, text, logos, graphics and branding, is owned by or licensed to Mini Atlas Co. and is protected by applicable intellectual property laws.

Website content is provided for personal, non-commercial use only.

Without our prior written permission, you must not reproduce, copy, adapt, manufacture from, distribute, publish, sell, commercially exploit or create derivative works from Mini Atlas Co. artwork, designs or other protected content.

You must not systematically scrape, extract or collect website content for commercial use.

Nothing in these Terms transfers any intellectual property rights to you.

7. Website Use

You must not use our website for unlawful purposes or in a way that may damage, interfere with or compromise the website, its security or the experience of other users.

You must not knowingly introduce malicious software, attempt unauthorised access to our systems, or use automated methods to interfere with the operation of the website.

We may restrict access where reasonably necessary to protect the website, Mini Atlas Co., our customers or third parties.

8. Liability

Nothing in these Terms excludes or limits liability, consumer guarantees or other rights that cannot lawfully be excluded or limited.

To the maximum extent permitted by law, Mini Atlas Co. is not responsible for loss or damage caused by misuse or improper care of a product, inaccurate information supplied by the customer, circumstances outside our reasonable control, or third-party websites or services that we do not control.

To the extent permitted by law, we are not liable for indirect or consequential losses that were not reasonably foreseeable.

9. Shopify

Mini Atlas Co. is powered by Shopify, which enables us to provide the online store and related services.

Sales and purchases made through our store are made directly with Mini Atlas Co.

Shopify provides the ecommerce platform but is not the seller of Mini Atlas Co. products.

10. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our business, website or legal requirements.

Any updated Terms will apply from the date they are published and will not retrospectively alter the terms governing an order already accepted, except where required by law or agreed with you.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be treated as removed or limited to the extent necessary, and the remaining provisions will continue to apply.

12. Governing Law

These Terms & Conditions are governed by the laws of Victoria, Australia.

Nothing in this section affects any mandatory rights or protections available to consumers under the Australian Consumer Law or other applicable law.
